gift deed vs sale deed   Dear Sir/Madam,

I am law student, I just what to know the answer for the below question.

As per law (transfer of property act), gift deeds with out conditions can not be revoked once registered. We can register gift deeds for non- blood relatives also.

Stamp duty for gift deed is very less when compared to sale deed. My question is why people prefer sale deed while buying properties even though the stamp duty for gift deed is less.


Please help me regarding this issue if you know the exact answer or simply donít answer. (Refer transfer of property act or gift law)

   Dear,
of course duty levied on sale is more than gift deed,,but when proper consideration is paid on transfer of property , no one put himself on risk as few gifts deed are revocable,,
secondly gifts are done with affection love but sale is for consideration and value paid,,,and best title on property can acquire through sale deed only,,

   When property is sold, consideration is "sale money" for a business deal. When property is gifted, then money is not the consideration but it is out of love, affection, gratitude etc. The spirit behind both the transactions are inversely proportionate to each other. If close relationship is not established, gift deed is not get registered. Gift deed is venerable to challenge by other party. Intention to make hole in the Govt exchequer for personal gains is unlawful.

the stamp duty for the gift deed is less if the property is conveyed to only the blood relatives
other wise even it is gift deed the stamp duty like sale deed must be paid
