A group of Second Amendment advocates, including the Firearms Policy Coalition and the Calguns Foundation, filed a complaint Tuesday in the United States District Court Southern District of California seeking to have California Penal Code Section 27510 declared unconstitutional.
California Governor Jerry Brown signed Section 27510, which raised the minimum age to purchase a gun from 18 to 21, into law late last year. The gun rights groups suing California argue that such a law infringes on the Second Amendment rights of many adult citizens:
Penal Code section 27510 prohibits lawful, responsible, adult citizens between the ages of 18 and 21 from purchasing firearms of any type from any source as it prevents federal firearms licensees from selling, supplying, delivering, or giving possession or control of any firearm to any person under 21 years of age.
The Second Amendment advocates seek a declaration that Section 27510 is unconstitutional on its face, a temporary and permanent injunction of Section 27510, as well as remedies available under 42 U.S.C. § 1983.
